29 December 2024The project got its first sanction from PMRDA on 5.04.2019 wherein B plus G floor + 8 floors for residential building and B + G floor for commercial building was sanctioned. Amenity space and road widening area to be handed over to PMRDA was demarcated on the sanctioned plan. The amenity space and area for road widening was handed over to PMRDA. Project got revised sanction from PMRDA on 04.11.2020 wherein residential building got sanction till 12 floor (B + G floor plus 12 floors) and commercial till B + G floor only. The commercial building got its plinth check certificate on 08.07.2021 which was issued by PMRDA wherein it is mentioned that RCC work of ground floor of commercial building is completed. On 2.8.21 PMRDA Draft Plan was published wherein proposed 30 M wide draft DP road was shown on the commercial building. Aggrieved by this arbitrary action of the PMRDA, Promoter has moved application to PMRDA and appealed to realign the proposed DP road as it is unjust to shift the road on committed development. Project got revised sanction from the PMRDA on 03.12.2021 wherein residential building got sanction till 12 floor (B + G + 12) and for commercial building till 3 floor (B + Gr + 3). The proposed 30 M wide draft DP road is marked on the sanctioned plan which has created obstruction for prospective buyer to purchase the commercial unit in project. A notice was issued by the PMRDA on 05.05.2022 to give statement before planning committee to record grievances. We have raised this issue before PMRDA, they acknowledged their mistake by sending a letter dated 15.06.2022 to Planning Dept that they consider the realignment of the draft DP road as it affects the committed development. The grievance is raised before the expert committee constituted for this purpose. Promoter has received Completion Certificate on 03.03.2023 for Residential Building ONLY and the Promoter has handed over possession to all residential unit holders by registering a deed of apartment. Considering contingency of proposed Draft DP Road Promoter seeks project extension u/s 6 of the Act for one year. Promoter draws attention of authority that the work progress of commercial building got stuck by the arbitrary action of PMRDA. The completion of the Commercial building and in sense completion of the project is contingent upon the time the concerned authority will take to realign the proposed DP road so as to not affect Commercial Building of the said project, a committed development.

Project got revised sanction from PMRDA on 4.11.20 wherein residential got sanction till 12th floor (B+G+12 floors) and commercial till B+G. The commercial building got its plinth check certificate on 8.7.21 which was issued by PMRDA wherein it is mentioned that RCC work of ground floor of commercial is completed. On 2.8.21 PMRDA Draft Plan was published wherein proposed 30 M wide draft DP road was shown on the commercial building. Aggrieved by this arbitrary action, Promoter has moved application on 27.8.21 and appealed to realign the proposed DP road as it is unjust to shift the road on committed development. Project got revised sanction from the PMRDA on 3.12.21 wherein residential got sanction till 12th floor and for commercial till 3rd floor. The proposed 30M wide draft DP road was marked on the plan which has created obstruction for prospective buyer to purchase the commercial unit in project. Notice was issued by PMRDA on 05.05.2022 to give statement before planning committee to record grievances. We have raised issue before PMRDA, they acknowledged their mistake by sending letter dt15.06.22 to Planning Dept that they consider realignment. Grievance was raised before expert committee. Promoter received Completion Certificate on 3.3.23 for Residential Building A. Promoter has handed over possession to all residential unit holders by registering a deed of apartment. On 27.12.23, MAHARERA has extended project deadline in accordance with section 6/7 of the Act till 29.12.24. On 20.3.24, we received completion certificate for club house (Gr + first floor) and for commercial building B (Shops 1 to 8). The shop owners were given possession after registering their respective apartment deed. The proposal was submitted for revised sanctioning till 10th floor and after due scrutiny PMRDA issued revised sanctioning for commercial building on 5.7.24. Considering the above-mentioned developments Promoter seeks project extension u/s 7 (3) of the Act for two years without consent of allottees as each and every allottee from residential as well as commercial building has been given possession and respective apartment deed is registered as those units have received completion certificate.
