| 31 October 2026 | The project was originally registered on the basis of the Commencement Certificate, with the declared completion date of 31/12/2025. Subsequently, demarcation of the project land was proposed, pursuant to which a government survey was required and duly applied for. Despite the promoter having followed up and having waited for a considerable period, the government survey has not been completed within the stipulated time and is still pending with the concerned government surveyor. The said delay is entirely attributable to the statutory authority and is beyond the control of the promoter, and not due to any act, omission, or negligence on the part of the promoter. Notwithstanding the above, the promoter has commenced construction of the clubhouse and water tank, which constitutes the only balance development work in the said plotting project. In view of the aforesaid circumstances, which are unintentional and beyond the promoter’s control, the promoter has applied for an extension of 10 months i.e. upto 31/10/2026 under the applicable provisions of the RERA Act and MahaRERA Rules, solely to complete the remaining development works. Further, the promoter has duly informed the allottees of the project about the delay and the consequent requirement of extension of the project timeline. The promoter made bona fide efforts to communicate the proposed extension to the allottees and to obtain their consent and obtained more than 51% of consents from the allottees. The promoter submits that the delay in completion has arisen solely on account of statutory approval delays by the planning authority, which are beyond the control of the promoter, and not due to any wilful default or negligence. |
